When we build tracking, follow-up systems, or automations for a client, we may handle personal data belonging to that client's leads and customers during the build, testing, and handover. In those situations the client is the controller of that data and DW Funnel acts as a processor on the client's instructions.

We access client-side data only as needed to deliver the project, we do not use it for our own purposes, and access ends at handover unless ongoing support is agreed. A data processing addendum is available on request for clients who require one.

Users in the United States, Canada, and Australia

If you are in the United States, some state privacy laws give residents specific rights over their personal information. We do not sell or share personal information for cross-context behavioural advertising. To exercise any rights available to you under your state's law, contact us using the details below.

If you are in Canada, we handle personal information in line with the principles of the Personal Information Protection and Electronic Documents Act (PIPEDA). Terms of Service

These Terms govern your use of the DW Funnel website and, where applicable, services provided by DW Funnel.

DW Funnel is operated by Deedap Harmony PLT, a business based in Malaysia.

Specific client projects may also be governed by a proposal, quotation, statement of work, invoice, written scope, or other project agreement.

If a project-specific written agreement conflicts with these general Terms, the project-specific agreement will take priority for that engagement.

Services

DW Funnel provides services that may include strategy, landing page design, web development, conversion-focused systems, tracking configuration, automation, follow-up systems, and related digital work.

The exact deliverables for each project will be defined in the agreed project scope.

Website use

You may use this website for lawful purposes.

You must not knowingly:

• interfere with the site’s operation or security
• attempt unauthorised access
• submit malicious code
• misuse forms or communication channels
• copy or exploit protected website content in violation of applicable rights

Fees and payment

Project fees, deposits, payment schedules, currencies, and payment deadlines will be stated in the relevant proposal, quotation, invoice, or project scope.

Work may be paused where an agreed payment is overdue.

Overdue amounts may accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower, from the due date until paid.

Unless otherwise stated in writing, fees already paid for work completed, time reserved, or third-party costs incurred are not refundable.

Client responsibilities

Clients are responsible for providing accurate information, timely feedback, required access, approvals, content, brand assets, and any other materials reasonably needed to complete the project.

The client confirms that they have the necessary rights to any content, trademarks, images, data, or materials they provide to DW Funnel.

The client agrees to cover reasonable losses and costs DW Funnel incurs from third-party claims that materials supplied by the client infringe someone else's rights.

DW Funnel is not responsible for delays caused by missing information, delayed approvals, unavailable access, or other dependencies outside our reasonable control.

Timelines

Any timeline or launch date is based on the agreed project scope and the client’s timely cooperation.

Project timelines may change where:

• the scope changes
• feedback or approvals are delayed
• required content or access is unavailable
• third-party platforms cause delays
• circumstances outside our reasonable control affect delivery

Revisions and scope changes

The number of revisions included in a project will be stated in the project scope where applicable.

Requests outside the agreed scope, additional revisions, new deliverables, or material changes to approved work may require additional fees and timeline changes.

Any additional work should be agreed before it is carried out.

Third-party services

Projects may rely on third-party platforms, software, hosting providers, APIs, payment processors, CRMs, advertising platforms, automation tools, fonts, stock assets, plugins, or other external services.

Unless specifically included in the project scope:

• third-party subscription or usage fees are the client’s responsibility
• third-party services remain subject to their own terms and licences
• DW Funnel does not control the continued availability, pricing, policies, functionality, or downtime of third-party services

DW Funnel is not responsible for failures or changes caused solely by third-party services outside our reasonable control.

Ownership

Once all amounts due for a project have been paid, the client owns the final deliverables created specifically for that project, subject to the terms below.

DW Funnel retains ownership of its pre-existing and reusable materials, including:

• tools
• reusable code
• components
• systems
• methods
• processes
• templates
• frameworks
• know-how

Third-party software, open-source software, fonts, stock assets, plugins, libraries, and other licensed materials remain subject to their respective licences.

Where reusable, pre-existing, or third-party materials form part of the final deliverable, the client receives the rights reasonably necessary to use the completed project as intended.

Portfolio

Unless otherwise agreed in writing, DW Funnel may display non-confidential parts of completed work in its portfolio, website, social media, presentations, or other promotional materials after the work has been made public.

We will not intentionally disclose confidential business information.

A different arrangement may be agreed in writing where confidentiality is required.

Confidentiality

Each party should take reasonable care with confidential information received from the other.

DW Funnel will not intentionally publish or disclose confidential client information except where required to provide the services, with the client's permission, or where required by law.

This general clause does not replace a separate NDA where one has been agreed.

Client data

Where DW Funnel handles personal data belonging to the client's leads or customers as part of a project, DW Funnel acts as a processor on the client's instructions, as described in the Privacy Policy. A data processing addendum is available on request.

Results

DW Funnel designs and builds systems intended to improve clarity, user experience, conversion paths, and marketing performance.

However, marketing outcomes depend on factors outside our control, including:

• the offer
• pricing
• market demand
• traffic quality
• advertising
• sales process
• follow-up
• competition
• client execution

We do not guarantee specific revenue, profit, leads, conversion rates, booked calls, sales, or other business outcomes unless explicitly agreed in writing.

Cancellation and termination

Either party may end a project in accordance with the relevant project agreement or by written notice where no specific termination terms have been agreed.

If a project ends early, the client remains responsible for:

• work completed up to the end date
• time already reserved for the project
• approved third-party costs already incurred
• any other amounts already due

DW Funnel will provide completed or paid-for deliverables where reasonably applicable and subject to full payment of outstanding amounts.

Limitation of liability

To the maximum extent permitted by law, DW Funnel and Deedap Harmony PLT will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from the website or services, including loss of profit, revenue, business opportunity, data, or goodwill.

To the maximum extent permitted by law, our total aggregate liability arising from a paid project will not exceed the amount actually paid to DW Funnel for the specific project giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Governing law

These Terms are governed by the laws of Malaysia.

Any dispute will be subject to the jurisdiction of the courts of Malaysia, unless a different arrangement is expressly agreed in writing.

Changes to these Terms

We may update these Terms from time to time.

The latest version will be published on this page with the updated effective date.

Changes to these website Terms do not automatically rewrite an already signed project-specific agreement unless otherwise agreed.
